Section I

Name, location, policy of activity of the Federation

§1

Europejska Federacja Radioorientaciji Sportowej, shortly EFRS,(European Radio Sport Federation, shortly  ERSF; Европейская Федерация Радиоспорта, shortly ЕФРС), hereinafter called the Federation, was established on 9th of October, 1999 in the city of Helme Lubelsk in Poland by the national organizations of Lithuania, Moldova, Poland and Ukraine, showing interest to radio sport.

 

§2

The location of the Federation – city of Warsaw, capital of Poland.

 

§3

The purpose of activity of the Federation:

1) popularization of  radio sport among children, youth and adults;

2) granting the opportunity sport to any person to be engaged with radio sport if the interest to this kind of sport is shown;

3) promotion of radio sport, as kind of the sport having positive influence on a state of health, psychologically – physical ability and formation of proecological attitudes;

4) development оf international cooperation on radio sport;

5) aspiration to introduction of radio sport in the program of Olympic games.  

§3a

The following definitions have been adjusted:

1) Radio Sport is a term denoting a branch of sport which consolidates the disciplines of sports, the purpose of which is the definition and finding of the set position of competitions by the way of movement, a place of position of all set sources of electromagnetic raditation of the certain frequency or other certain objects by the means of engineering used in telecommunication, radio direction finding or navigation during the shortest time and with accuracy. In particular it includes the following disciplines:

- radio direction finding sport,

- radio orienteering (Foxoring) sport,

- satellite navigation sport,

And all the other on-site disciplines of sports when using the radio engineering means are included.

2) Radio direction finding sports is the term denoting the discipline of radio sport, the purpose of which is the definition and finding of the certain site of the certain quantity of radio transmitters by means of radio reception devices, sport map and compass. The radio transmitters are as follows:

- Unmarked on a sports map;

- Designated on district number subject to the item, placed on a prism, which color and size are defined by the position of competitions;

- Sequentially emitting radio signals in the certain time intervals;

It is the measurement of directions of the reception of radio signals, which are emitted by localized radio transmitters from any place of the entire competition area.

3) Radio orienteering (Foxoring) sports is the term denoting the discipline of radio sport, the purpose of which is the definition and finding of the certain site of the certain quantity of micro transmitters by means of radio - reception devices, sports map and compass. Micro transmitters are as follows:

- Unmarked on the sports map;

- Designated on district number subject to the item, placed on a prism, which color and size are defined by the position of competitions;

- Working in a constant mode, with the power of radio emissions limited up to size enabling the possibility of the reception of the signals emitted by them within the radius of 150 ± 20m. from micro transmitter.

It is the measurement of the reception of the signals from each of micro transmitters from any zone designated on the sports map. The radio signals are emitted by localized micro transmitters.

4) Satellite navigation sports is the term denoting the discipline of radio sport, the purpose of which is the definition and finding of the installation sites of the certain quantity of control items by means of sports map and electronic reception device, which enables the possibility to define geographical coordinates of the installation site of the reception device by means of the received radio signals, which are emitted by artificial satellites of the earth and which operate in the certain global system of the satellite navigation (for instance, GPS, etc.). The control item are as follows:

- Located in places, which are defined by specific geographical coordinates;

- Unmarked on a sports map;

- Designated on district number subject to the item, placed on a prism, which color and size are defined by the position of competitions;

Section II

Means for realization of tasks

§4

For the realization of the tasks mentioned above, the Federation:

1) Organizes competitions on superiority of region and continent;

2) Takes part in the organization of the world Championship;

3) Establishes rules of employment on radio sport;

4) Assists on instructing for the organization of the state administration, the international and local organizations, and also figures in the field of development of radio sport in Europe and in the world;

5) Cooperates with appropriate branches of the United Nations Organization (UNO), the International Olympic committee and  the national organizations - the Council of Europe, the International Amateur Radio Union, the International Federation of orientation, and also the international organizations promoting development of sport, propagating and educating a healthy way of life.

§5

The Federation is guided by a principle of freedom of belief and does not suppose any discrimination on political, religious, racial, national and financial reasons or on belonging to other organizations.

 

 

§6

1) Official languages of the Federation (for correspondence, seal, the organization of the international contacts) are: English, the Polish or Russian languages.

2) The choice of language at bilateral meetings and also during competitions on the country with participation of foreign teams, belongs to the organizer of a meeting.

§7

The member organizations of the Federation have a full autonomy. On international scene these organizations sovereign if their activity does not break the present charter.

§8

The federation can use seals in the languages listed in 6th paragraph, 1st clause.

Section III

§9 The arms, flag and hymn of the Federation

The arms of the Federation is the contour of a silhouette of the running sportman with a radio receiver of ultrashort waves of blue color on the yellow background, surrounded with blue circle. Outside the circle the name of the Federation on one of the languages mentioned in 6th paragraph, 1st clause is written.

§10

The flag and hymn of the Federation are established by general meeting of the delegates, hereinafter called the Congress of Federation.

Section IV

Members of Federation

§11

1) The Federation unites usual, extraordinary and honorary members.

2) A usual member of the Federation can be the national organization (league, federation, the sport union, a society or the organization appropriate to them) of any European country, recognized as the appropriate general sport authorities conducting in the field of radio sport.

3) An extraordinary member of the Federation can be the organization of any country showing interest to radio sport.

4) The honorary member of the Federation can be the physical or legal person, especially deserved in development of radio sport in Europe or in the world.

5) Usual and extraordinary members are accepted by the Council of Federation by the majority of voices.

6) The rank of the honorary member of the Federation is appropriated by the Congress of Federation, under the offer of the Council of Federation, accepted by the majority of voices.

7) Refusal of membership of the Federation occurs under the application of the interested organization sent to the Council of Federation after performance of all duties in relation to the Federation.

8) Staying in rights of a member of the Federation comes as a result of the decision of the Presidium of the Council of Federation, accepted by the majority of voices. Such decision should be considered at the nearest session of the Council of Federation.

9) Deprivation of membership of the Federation occurs under the application of the Council of Federation as a result of the decision of the Congress of Federation accepted by the majority of 2/3 voices of delegates, having the right to vote. The decision of the Congress of Federation is final and it is not a subject to the appeal.

§12

1) The payment of membership dues is a duty of all the members of the Federation.

2) Delay of the payment of membership dues causes loss of a casting vote in the Council of Federation and during the Congress of Federation, and also deprivation of any forms of material aid of the Federation up to the moment of payment of the outstanding and current payments.

§13

Members of the Federation are obliged to resolve disputes arising between them inside the Federation, and disputes with the Federation in the arbitration order through the international body, established in the way of the agreement of the both sides.

Section V

Authority of the Federation

§14

Authorities of Federation are:

1) The Congress of Federation;

2) The president of the Federation elected by the Congress separate voting;

3) the Council of Federation;

4) Presidium of Council of the Federation;

5) Supervisory – auditing committee.

§15

1) The Congress of Federation is the supreme body of authority and carries out the supervision on set of its activity. The General Congress is convoked each 4 years.

2) Delegates of the usual and extraordinary members elected on the basis of regulations about how elections take part in the Congress of Federation, established by the Council of Federation and with a deliberative vote members of leaving authorities of the Federation with a casting vote. Powers of members’ delegates are valid before convocation of the following General Congress.

3) The Congress of Federation occurs in a place and during realization of the international competitions on radio sport.

4) Delegates for the participation in the Congress of Federation should be notified about the place, term and agenda of the session not less than 30 days prior to its beginning.

5) The Extraordinary Congress of Federation is convoked by the president of the Federation under the written application of the Council of Federation or not less than 2/3 votes of usual members of the Federation and not later than within 90 days after receipt of the application and sits on questions for which the meeting is convoked.

6) Exclusive competence of the Congress of Federation includes:

    1. approval under the application of the revision Committee, the report of activity of the president of Federation and the Council of Federation for past term of their powers;

    2. giving a rank of the honorary member of Federation;

    3. election of authorities for the following term of office;

    4. changes of the charter of the Federation, including establishment or change of a flag, the arms and a hymn;

    5. statement or cancellation of the decision of other authorities of the Federation;

    6. deprivation of membership in the Federation;

    7. termination of activity of the Federation with definition of a way of liquidation and the purpose of applying the Federation’s property.

§16

1) The Council of Federation assembles between the Congresses of Federation, not less often than once a year, basically on a place and during realization of the international competitions at a level of the championship.

2) The Council of Federation is made by representatives of member organizations (usual and extraordinary members) on the basis of the written power of attorney (delegation of competences) authorities of the organizations (on one representative), and also members of the Council of Presidium of the Federation.

3) Exclusive competence of the Council of Federation includes:

1. approval of activity report of the Federation president, the Presidium of Council and acceptance of decisions (under the application of supervisory-auditing committee  of the Federation), concerning the approval of above-stated authorities’ activities for the past calendar year;

2. assignment of person acting as president of the Federation for the period between the Congresses of Federation;

3. changes of structure of the Presidium Council of the Federation;

4. statement of periodic programs of the activity and the budget of the Federation and also approval of reports about their performance;

5. creating the international rules of radio sport;

6. preelection of new members of the Council of Federation in process of inclusion new organizations to the Federation;

7. consideration of decisions of the Presidium Council of the Federation, which demand their statement;

8. statement of the international sport calendar;

9. definition of the size of a membership dues and term of its payment.

§17

1) The Presidium Council operates the current activity of the Federation and its property.

2) Presidium includes: the president of the Federation, two - three assistants of the president, the general secretary and the treasurer.

3) To the competence of Presidium of Council of the Federation concern, in particular:

1. estimations of applications for inclusion of new members or statement with the offer on refusal of their inclusion;

2. acceptance of decisions on purchase, sale or tenancy of components of the Federation property;

3. development of international sport calendar;

4. granting national member organizations their right on the organization of the international competitions at a level of the championships;

5. assignment of agencies – advisers, i.e. Board of judges, disciplinary commissions, and also the statement of the schedule of their activity;

6. assignment and a cancellation of the international judges on radio sport;

7. reference in the Council of Federation with the offer of convocation of General or Extraordinary Congress of the Federation;

8. acceptance of decisions on a question of convocation the session of the Federation Council.

§18

1) The president is selected by the Congress of Federation secret or open voting by showing the hands, by the majority of 2/3 voice from quantity of the authorized delegates.

2) The president of Federation represents the Federation in the international connections, presides to the Congress, Federation Council of and the Council Presidium of Federation.

3) The president can transfer the duties and the competence to the assistant, under condition of written definition of term and a circle of transmitted powers and responsibilities.

4) The president of Federation has the right:

1. to put tasks to the members of the Presidium and the Council of Federation;

2. to carry out supervision of activity of the Council of Federation bureau;

3. to apear at the international competitions on the radio sport, organized by members of the Federation;

4. to represent authorities of the Federation while deciding its projects;

5. to offer the member organizations of Federation to undertake the actions promoting development of radio sport.

§19

1) The general secretary of the Federation is responsible for performance of decisions of the Congress, Council, Presidium of Council of the Federation and the president of Federation;

2) The general secretary of the Federation creates a bureau of Council of Federation and operates its activity, in particular, employs the employees.

§20

The treasurer of Federation is responsible for money resources and property.

§21

1) The bureau of Council of the Federation serves to the president of Federation, Сouncil and Presidium of Council of the Federation, according to the requirements of these authorities.

2) The bureau of the Federation works according to the rules authorized by the Presidium of Council of the Federation.

§22

1) The supervisory-auditing commission consists of three persons, including the chairman.

2) The supervisory-auditing committee not less often than once a year supervises all activity of authorities of the Federation, with the reference of special attention to questions of money resources and property.

3) The supervisory-auditing commission represents reports:

1. once a year – to Council of the Federation, offering approval of activity for the president and Presidium of Federation for past year;

2. to the Congress of Federation, offering approval of activity for the Council of Federation.

4) The supervisory-auditing commission has the right to appeal to authorities of the Federation with the offers connected to control establishments and to demand explanations, also elimination of abnormalities.

5) The volume of activity of the supervisory-auditing commission, its organization and the operating procedure is determined with the rules accepted by the decision of the Commission.

Section VII

Agencies - advisers of Council of the Federation

§23

1) The Agency – adviser of Council of the Federation, created for the questions connected to performance of a duty of the judge at the international sport competitions on radio sport, is the Board of judges.

2) The Board of judges consists of 5-9 international judges on the radio sport, it is elected by the Presidium of Council of the Federation among the candidates submitted by the member organizations.

3) The Board operates according to the rules authorized by the Presidium of Council of the Federation.

4) The Board of judges carries out examinations, assesss and addresses with the offer in the Presidium of Council of the Federation on a question of assignment and a cancellation of the international judges on radio sport.

5) The Board of judges provides training for the candidates for the international judges on radio sport among the judges of the first class offered by the member organizations of the Federation.

§24

1) The Agency – adviser of the Council of Federation, created for decisions of any questions, to infringement of technical and disciplinary positions in the charter of the Federation during realization or in connection with the international competitions on the radio sport, organized by members of the Federation, is the Disciplinary commission.

2) The Disciplinary commission does not interfere with the questions which have arisen during realization or in connection with competitions, happening in the country.

3) Members of the Disciplinary commission is in quantity of 5-9 persons, appointed by the Presidium of Council of the Federation among the candidates submitted by the member organizations.

4) The disciplinary commission operates on the basis of the rules authorized by the Presidium of Council of the Federation.

5) The Disciplinary commission can make the decision on the announcement void of the results achieved at competitions, or withdrawal of medals, captured in the Championships of Europe or the Cup of Europe. The decision of the Commission on this question, is subject to the statement Presidium of Council of the Federation.

6) The Disciplinary commission has the right to act in the appropriate national agencies of organizations - members of the Federation with the offer of:

1. time discharge of persons, which manufactures are conducted before the Commission, up to the moment of acceptance and validity of the decision;

2. time or life disqualification of the sportman, the judge, the trainer or the figure which are recognized guilty gross infringement of technical or disciplinary positions of the Federation;

3. deprivations of sport club of the right on participation in the international competitions organized by members of the Federation.

7) The Disciplinary commission is obliged to act in appropriate agencies of the Federation with the offer:

1. stay in membership or a response of a member of authorities of the Federation or the international judge on radio sport which manufacture is conducted or which are recognized guilty gross infringement of the technical or disciplinary positions determined by the Council of Federation;

2. stay in membership or exception of a member of the Federation which does not react to offers and the requirements of the Commission following from the 24paragraph, 6 clause.

8) The Disciplinary commission has the right to direct the representative, as the observer, on the championships organized by a member of the Federation for supervision of pass the competitions, including, in particular, the procedures of
antidrug-taking control.

Section VIII

Authorized activity of Federation

§25

1) The basic authorized activity of the Federation is creation of conditions for development of radio sport in Europe, including unification of sport positions and the organization of sport rivalry by this kind of sport.

2) World situations on radio sport operate for members of the Federation in edition of the text of the Council of Federation. During editing projects of positions, former experiences of Constant working group on questions are taken into account of ARDF of the first region of IARU and the national organizations of radio sport.

3) The sport rivalry organized by the Federation is open for all sportmen having license and all sport organizations, despite purchases of membership of the Federation. Members of the Federation can participate in this rivalry on preferential financial principles. These preferences are a subject of bilateral agreement of the organizer of competitions to the Presidium of Council of the Federation.

§26

1) Decisions of the Congress, Council and Presidium of Council of the Federation are valid, despite the quantity of the present delegates, under condition of the notice properly all usual and extraordinary members of the Federation about convocation of this collective.

2) Decisions of authorities of the Federation are accepted by the majority of voices, except the decision on deprivation of membership in the Federation, and also about change of the charter (by 2/3 vote of all the present delegates) and about the termination of activity of the Federation (3/4 vote of all the present delegates).

3) The questions being put by national organization – member, can not be considered without participation of the authorized representative of this organization if another organization – member or the Presidium of Council of the Federation does not receive the written power of attorney of the applicant to represent it.

4) Object of the sessions of the Congress of Federation each time should be:

а) the report on an organizational condition of the Federation, participation of delegates and validity of the Congress;

b) the report of the president of the Federation on a condition of decisions’ realization of the former Congress and the major current problems;

c) the report on the activity, concerning decisions accepted by the Council of the Federation, during its term of office;

d) the financial report of the treasurer for a past term of office;

e) the report of the chairman representing the judiciary Board;

f) the report of the chairman of the Disciplinary commission;

g) complaints, appeal of decisions of the Federation and free applications, which were received in written form in the Congress through the Bureau of Council of the Federation by the certified mail, with date of departure not less than 60 days prior to term of the beginning of realization of the Congress of Federation.

§27

1) The term of office of authorities of the Federation proceeds four years.

2) Members of authorities of the Federation have the right to repeated election, without restriction, number of terms of office.

3) Authorities of the Federation have the right to preelect new members in a place leaving during a term of office, with the clause of superiority of promotion of a nominee for an organization – member which representative has left structure of authorities.

4) The preelection of new members, stipulated in the 3rd clause, can not exceed 50 percents of structure of the authorities elected the Congress of the Federation.

5) In case of a leaving of the president of Federation before a termination date of powers, the Council of Federation has the right to appoint acting as a president or to call the Extraordinary congress of the Federation.

Section IX

Money resources and property of Federation

§28

1) Property of the Federation are the real estate, personal estate and money resources.

2) Money resources make:

1. membership dues;

2. receipts from the competitions organized by the Federation and by organizations - members authorized by it;

3. donations;

4. grants and grants for performance of the certain tasks, the enterprises of governmental and non-governmental organizations, both national, and international;

5. receipts from the economic activities spent according to a law in force.

3) The validity of decisions on property questions of the Federation needs interaction of the president of the Federation or the assistant to the president authorized by him, and also the treasurer or the general secretary of the Federation.

4) Activity of the persons mentioned in the third clause, is exposed not less often that once a year to an estimation of the Council of Federation in a voting procedure on approval of activity. The Council of Federation has the right to call the constant or time commission for research property status of the Federation, expediency and conformity of lawful activity of the persons mentioned in the third clause.

§29

1) Changes in the present charter can be entered by extraordinary decision of the Congress with the qualified majority of 2/3 voices in presence not less than half of quantity of delegates. Changes of the Charter are subject to registration of appropriate Register court.

2) The termination of activity of the Federation occurs on the basis of the decision of the Congress with the qualified majority of 3/4 voices despite of quantity of the presence delegates under condition of the notice properly all organizations - members of the Federation.

3) The decision on the terminating the activity of the Federation by name should determine the liquidator of questions of the Federation, the purpose of applicability of property of the Federation and to oblige the liquidator to except the Federation out of the register in appropriate Register court.
